WFAE reported that at-large City Council member James Mitchell would resign this afternoon in the wake of his becoming 25% owner of a construction company that does business with the city.
State law prohibits companies from conducting such business if any owner who serves in an elected position owns more than 10% of the company.
Mitchell was first elected to council from District 2 in 1999.
